Teilnahmebedingungen für Bands :

Ihr seid an der Teilnahme eines Tribute Samplers bei Radio Body Music / 80s Records interessiert?

Dafür sind einige Punkte zu beachten :

1. Technische Details :

Bitte schickt uns euren Beitrag ausschließlich mit folgenden technischen Spezifikationen zu :

- als .wav (keine anderen Formate!)
- gemastert (keine pre-Master oder ungemasterte Versionen!)
- ausschließlich 16 oder 24 Bit (keine höheren Bit-Raten)
- 44,1 kHz (keine andern kHz-Raten)

Wir brauchen ZWEI verschiedene gemasterte .wav :

- 1 x normalisiert (0 dB)
- 1 x - 3 dB

Solltet ihr was anderes schicken als oben angegeben und das fällt kurz vor der Veröffentlichung auf, kann das bedeuten dass euer Beitrag nicht berücksichtigt wird!

Benennung der Lieder :

Bitte benennt die Lieder AUSSCHLIESSLICH so :

1. NAME DER BAND - LIEDNAME (-3 dB).wav
2. NAME DER BAND - LIEDNAME (0 dB).wav

2. Die Cover-Version :

Die Cover-Version muss sich an das Original halten. Lediglich kleine Änderungen in Arrangement, Harmonie und Rhythmus, also in der groben Klanggestalt können vorgenommen werden. Die Neuinstrumentierung ist erlaubt.

Es darf sich nicht um eine Entstellung des originalen Liedes handeln!

Ihr müsst euch an den originalen Text des zu covernden Liedes handeln. Veränderungen des Song-Textes sind nicht erlaubt.

Für die Nichteinhaltung des Punkt 2. dieser Bedingungen seid ihr alleinig verantwortlich und tragt alleinig alle rechtlichen Folgen.


3. Formate der Veröffentlichung und Verdienst :

- Download über MusicHub in ca. 120 Stores und über Bandcamp :

>>> Die Einnahmen werden zu 50% an die Bands und 50 % an Radio Body Music / 80s Records aufgeteilt.

- 300 Exemplare als CD oder 2CD :

>>> Jede Band bekommt 2 Freiexemplare zugeschickt. Um es zu verdeutlichen : das sind für eine CD mit 16 Bands insgesamt 32 Freiexemplare und für eine 2CD mit 32 Bands insgesamt 64 Freiexemplare!
Wenn Bands an weiteren Exemplaren interessiert sind, gibt es für sie einen ermäßigten Verkauspreis.
Die Einnahmen von dem Verkauf der restlichen Exemplare müssen die Freiexemplare, die Portokosten als Kleinpaket für das Versenden an die Bands weltweit, die GEMA-Kosten (14,5 % vom Netto-Verkaufspreis) und die Verpackungsmaterialien bezahlen.
Die Bands haben uns ihre vollständige Adresse zukommen zu lassen.

- 50 Exemplare als MC (in einigen Fällen auch als 2 x MC) :

>>> Wegen der geringen Auflage bekommt keine Band Freiexemplare und vom Erlös des Verkaufspreises auch keine Anteile.
Die Einnahmen von dem Verkauf  der MC müssen die Freiexemplare der CD/2CD mitfinanzieren, deren Portokosten als Kleinpaket für das Versenden an die Bands weltweit, die GEMA-Kosten (14,5 % vom Netto-Verkaufspreis) für CD/2CD und die MC selbst und die Verpackungsmaterialien bezahlen.
Wenn Bands an weiMC teren Exemplaren interessiert sind, gibt es für sie einen ermäßigten Verkauspreis.

- 7" in Direct Cut Vinyl :

>>> Die 7" im Direct-Cut-Vinyl wird auf 30 Exemplare pro angebotener Vinylfarbe begrenzt. Die Vinylfarben sind : schwarz, durchsichtig, weiss, durchsichtig-rot, durchsichtig-grün und durchsichtig-blau.
Die Vinylfarben hängen vom Angebot der Ausführenden Firma ab. Anderungen ihrerseits können wir NICHT beeinflussen!
Jede Band bekommt für ihr Lied 5 € pro verkaufter 7" auf der sie drauf sind. Auf den Verkaufspreis sind 10 € Provision eingerechnet (2 x 5 € pro Band).
Es werden keine Belegexemplare an die Bands verschickt.
Body Music / 80s Records hat mit der 7" in Direct-Cut-Vinyl KEINEN Verdienst.
ACHTUNG : Hierbei handelt es sich um eine MISCHKALKULATION, da drei Vinylfarben etwas günstiger sind als der Verkaufspreis und drei Vinylfarben teurer als der Verkaufspreis!
Body Music / 80s Records zahlt hierfür die GEMA Gebühren.

Je mehr Werbung die Bands hierfür machen, desto größer die Verkaufschancen und desto höher eure Verkaufsprovision.

- 12" LP in Direct Cut Vinyl :

>>> Die 12"LP im Direct-Cut-Vinyl wird auf 50 Exemplare pro angebotener Vinylfarbe begrenzt. Die Vinylfarben sind : schwarz, durchsichtig, weiss, durchsichtig-rot, durchsichtig-grün und durchsichtig-blau.
Die Vinylfarben hängen vom Angebot der Ausführenden Firma ab. Anderungen ihrerseits können wir NICHT beeinflussen!

4. Laufzeit :

Die Laufzeit der Tribute Sampler als Download beträgt 3 Jahre.

Nach Ablauf der 3 Jahre nach der Veröffentlichung wird MusicHub beauftragt den betreffenden Tribute-Sampler aus den Stores zu löschen.

ACHTUNG : Von Store zu Store kann unterschiedlich lang dauern, bis diese den Sampler dann auch endgültig löschen. Radio Body Music / 80s Records haben KEINEN Einfluss darauf, wie lange das in den Stores dauert. Mit dem Auftrag zum Löschen des betreffenden Samplers ist unsere Arbeit damit getan.

Die Restbeständen der CDs/2CDs und der MCs können bis zu ihrem Abverkauf auch nach den 3 Jahren angeboten werden.

Die Direct-Cut-Vinyls werden nach dem Ablauf von diesen 3 Jahren nicht mehr angeboten.


5. Auszahlung :

Die Auszahlung erfolgt jeweils nach Ablauf eines Jahres.
Ist der Sampler z.B. im Januar eines Jahres veröffentlicht, erfolgt die Abrechnung im Januar des Nachfolgejahres.
Radio Body Music / 80s Records schickt jeder Band per eMail die Abrechnung mit Schreenshot der Digitalverkäufe von MusicHub und Bandcamp, sowie die Anteile über die verkauften 7" in Direct-Cut-Vinyl.
Die Auszahlung erfogt ausschließlich per Paypal an die von den Bands angegebenen Paypal eMail.



Die Bands erklären mit der Zusendung ihres Beitrages zu dem betreffenden Sampler auf dem sie ihre Teilnahme zugesagt haben, diese Teilnahmebedingungen gelesen und verstanden zu haben.

Are you interested in participating in a tribute sampler of  Radio Body Music / 80s Records?

There are a few things to consider:


1. Technical Details :

Please send us your song only with the following technical specifications:

- as a .wav (no other formats!)

- mastered (no pre-mastered or unmastered versions!)

- 16 or 24 bit only (no higher bit rates)

- 44.1 kHz (no other kHz rates)

We need TWO different mastered .wav files:

- 1 x normalized (0 dB)

- 1 x -3 dB

If you send something other than the one specified above and this is noticed shortly before publication, it may mean that your song will not be considered!

Song names :

Please name the songs ONLY like this:

1. BAND NAME - SONG NAME (-3 dB).wav

2. BAND NAME - SONG NAME (0 dB).wav

2. The cover version:

The cover version must adhere to the original. Only minor changes in arrangement, harmony, and rhythm—i.e., the general sound—may be made. Re-instrumentation is permitted.

It must not be a distortion of the original song!

You must adhere to the original lyrics of the song being covered. Alterations to the lyrics are not permitted.

You are solely responsible for any failure to comply with section 2 of these terms and conditions and bear all legal consequences.


3. Release formats and earnings :

- Download via MusicHub in approximately 120 stores and via Bandcamp :

>>> The proceeds will be splitted split 50% between the bands and 50% between Radio Body Music / 80s Records.
 

- 300 copies as CD or 2CD :

>>> Each band receives two free copies. To clarify: for a CD with 16 bands, that's a total of 32 free copies, and for a 2CD with 32 bands, that's a total of 64 free copies!

If bands are interested in additional copies, they will receive a discounted sales price.

The proceeds from the sale of the remaining copies must cover the free copies, the postage costs for shipping to the bands worldwide, the GEMA fees (14.5% of the net sales price), and the packaging materials.

The bands must provide us with their full address.


- 50 copies as MC (in some cases also as 2 x MC) :

>>> Due to the limitation, no band receives free copies and no proceeds of the sale price.

The proceeds from the MC sales must co-finance the free copies of the CD/2CD, the postage costs for shipping them to bands worldwide, the GEMA fees (14.5% of the net sales price) for the CD/2CD and the MC itself, and the packaging materials.

If bands are interested in additional copies, they will receive a discounted price.

- 7" Direct Cut Vinyl :

>>> The 7" Direct Cut Vinyl is limited to 30 copies per offered vinyl color. The vinyl colors are: black, transparent, white, transparent-red, transparent-green and transparent-blue.

The vinyl colors depend on the production company's offerings. We cannot influence any changes by the production company!

Each band receives €5 for each 7" sold on which they appear. A €10 commission is included in the sales price (2 x €5 per band).

No copies will be sent to the bands.

Body Music / 80s Records earns NO money from the 7" in Direct-Cut Vinyl.

PLEASE NOTE : This is a mixed calculation, as three vinyl colors are slightly cheaper than the sales price and three vinyl colors are more expensive than the sales price!

Body Music / 80s Records pays the GEMA fees for this.

The more promotion the bands do, the greater the sales opportunities and the higher your sales commission.


- 12" LP in Direct Cut Vinyl :

>>> The 12" LP in Direct-Cut-Vinyl is limited to 50 copies per offered vinyl color. The vinyl colors are: black, transparent, white, transparent-red, transparent-green and transparent-blue.

The vinyl colors depend on the company's offer. We cannot influence any changes made by them!

Body Music / 80s Records earns NO profit from the 12" LP in Direct Cut Vinyl.

The bands get NO profit from the 12" LP in Direct Cut Vinyl.

No copies of the 12"LP in Direct-Cut-Vinyl will be sent to the bands.

ATTENTION : This is a mixed calculation, as three vinyl colors are slightly cheaper than the retail price and three vinyl colors are more expensive than the retail price!

Body Music / 80s Records pays the GEMA fees for this.


4. Term :

The term of the Tribute Sampler download is 3 years.

After the 3-year period of the release, MusicHub will be commissioned to delete the Tribute Sampler from the stores.

ATTENTION : The time it takes to permanently delete the Sampler may vary from store to store. Radio Body Music / 80s Records has NO influence on how long this takes in the stores. Once the order to delete the Sampler is placed, our work is done!

The remaining stocks of CDs/2CDs and MCs can be offered for sale even after the 3-year period until they are sold out.

The direct-cut vinyls will no longer be offered after these 3 years.


5. Payment :

Payment is made after each year.

If, for example, the sampler is released in January of one year, the invoice will be issued in January of the following year.

Radio Body Music / 80s Records will email each band an invoice with a screenshot of their digital sales from MusicHub (all download stores) and Bandcamp, as well as their share of the 7" in Direct-Cut-Vinyl sold.

Payment is made exclusively via PayPal to the PayPal email address provided by the bands.



By sending us your song for the tribute-sampler to which you have confirmed your participation, your band declare that you have read and understood these conditions of participation and that you accept this conditions of participation.
